Terms and Conditions

Welcome to the MedFuel, Inc. healthcare-focused networking application (the “App”). These Terms and Conditions (“Terms”) govern your access to and use of the App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old and a healthcare professional or authorized user to use the App. By using the App, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use of your account at support@medfuelinc.com.
  • Update your account information to keep it accurate.

3. Use of the App

You agree to use the App solely for lawful purposes and in compliance with these Terms. You will not:

  • Use the App to transmit or share Protected Health Information (PHI) unless compliant with HIPAA and any applicable Business Associate Agreement (BAA).
  • Post or share content that is unlawful, defamatory, obscene, or violates the rights of others.
  • Attempt to gain unauthorized access to the App or its systems.
  • Use the App to send unsolicited communications (e.g., spam).

4. Intellectual Property

All content, trademarks, and materials on the App (excluding user-generated content) are owned by or licensed to MedFuel, Inc. You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal or professional networking purposes. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.

5. User-Generated Content

You retain ownership of content you post or share on the App. By posting content, you grant MedFuel, Inc. a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with operating the App. You represent that your content does not violate any laws or third-party rights.

6. HIPAA Compliance

If you are a covered entity or business associate under HIPAA, you are responsible for ensuring that your use of the App complies with HIPAA regulations. MedFuel, Inc. will enter into a Business Associate Agreement (BAA) with covered entities as required. Contact us at privacy@medfuel.com to request a BAA.

7. Third-Party Services

The App may integrate with third-party services (e.g., social media platforms or analytics tools). Your use of such services is subject to their respective terms and policies. MedFuel, Inc. is not responsible for the practices of third-party services.

8. Termination

We may suspend or terminate your access to the App at our discretion, including for violations of these Terms, suspected fraudulent activity, or legal requirements. You may terminate your account at any time by contacting support@medfuel.com. Upon termination, your right to use the App ceases, but provisions related to intellectual property, liability, and dispute resolution survive.

9. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. MedFuel, Inc. does not guarantee that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, MedFuel, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data, profits, or professional opportunities. Our total liability shall not exceed the amount paid by you, if any, to use the App.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [Insert State, e.g., Delaware], without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in [Insert City, e.g., Wilmington, Delaware], under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
